This section outlines the rights afforded to individuals or households in California ("California consumers").

Civil Code Section 1798.83: Pursuant to California Civil Code Section 1798.83, under specific conditions, upon receiving a request from a California consumer, a business may be obligated to furnish detailed information regarding the disclosure of that consumer's Personal Information to third parties for direct marketing purposes. However, this provision does not apply to entities such as ONE Performance that refrain from disclosing Personal Information to third parties for direct marketing purposes without prior consent or providing customers with a no-cost option to opt out of such disclosures for direct marketing purposes.

Rights under the CCPA: Effective January 1, 2020, the CCPA (California Civil Code Section 1798.100 et seq.) grants additional rights to California consumers concerning Personal Information identifiable to, relating to, describing, capable of being associated with, or reasonably linkable, directly or indirectly, to a specific consumer or household. While the categories of Personal Information we collect are generally outlined above, they may vary for individual consumers based on the Services utilized.

Under the CCPA, eligible California consumers may exercise the following rights:

Right to Know and Right to Delete.
California consumers possess the right to request disclosure of the Personal Information we collect, use, disclose, and sell, as well as to request deletion of Personal Information.

Upon receipt of a request to know or delete from a California consumer, we will acknowledge receipt within 10 days and provide details regarding the processing of the request, including our verification procedure. Responses to such requests will be provided within 45 days.

Right to Disclosure of Information.
California consumers may also request disclosure of specific types or categories of Personal Information collected by us.

We reserve the right to withhold such information under certain circumstances, including instances where disclosure poses a substantial, articulable, and unreasonable risk to the security of said Personal Information, customers' accounts, or our systems or networks. Additionally, we will not disclose social security numbers, driver's license numbers, government-issued identification numbers, financial account numbers, health insurance or medical identification numbers, or account passwords and security questions and answers.

Verifying Requests: For online requests, we employ a two-step verification process wherein the California consumer must first clearly submit the request and then independently confirm it. Other suitable measures will be utilized to verify requests received via mail or telephone.

When submitting a request, California consumers must provide adequate identifying information such as name, email address, residential or business address, or other details recorded with us to facilitate matching with maintained Personal Information. Avoid disclosing social security numbers, driver's license numbers, account numbers, credit or debit card numbers, medical or health information. Requests that are ambiguous or submitted through means other than those outlined above will prompt us to furnish specific directions for submission or remedy any deficiencies. Requests may be denied if requestor identity cannot be verified.

California Do Not Track Disclosure: Do Not Track is a privacy preference available through web browser settings.
